Terms of Use

1.1 Cashout operates an online platform on which owners and licensed salespersons may advertise residential and commercial property in Singapore, and on which prospective buyers and tenants may search those advertisements and submit enquiries.

1.2 Listings are created through a guided conversation rather than a form. The information recorded is that which the lister provides, together with locational information derived from mapping data.

1.3 In these Terms, "lister" means a person who submits a listing, whether as owner or as a salesperson acting for an owner; "content" means any material, information or response submitted to the platform by a user.

2.1 You must be at least 21 years of age to use the platform.

2.2 You may submit a listing only where you are the owner of the property, are duly authorised by the owner to market it, or are a salesperson registered with the Council for Estate Agencies ("CEA") acting in the course of your appointment.

2.3 A lister acting as a salesperson must provide their own CEA registration number and the name of their agency. We verify that registration number against the public register maintained by the CEA. Where the particulars provided do not correspond to that register, the listing will be withheld.

3.1 You warrant that all content you submit is true, accurate and not misleading, that you are entitled to submit it, and that it does not infringe the rights of any third party. You must keep your listing accurate for so long as it remains published.

3.2 You must not submit a listing in respect of a property that is not available, publish particulars that you know or ought to know to be incorrect, or reproduce photographs, floor plans or descriptive material belonging to another person as your own.

3.3 Every listing is subject to review before publication. We may withhold, amend, decline or remove any listing at our discretion and without assigning a reason.

4.1 Responses provided to prospective buyers and tenants are generated from the listing and from the answers given by the lister during their interview. The platform conveys what it has been told. It does not verify the truth of any statement made by a lister.

4.2 Where the platform expresses a view on price, that view constitutes a comparison against other listings published on the platform. It does not constitute a valuation, and you should obtain information from other sources.

4.3 Nothing on the platform constitutes valuation, legal, tax, financing or investment advice, nor is it a substitute for inspecting a property, commissioning a valuation, or obtaining advice from a solicitor or other licensed professional.

4.4 Automated responses may be incorrect or incomplete. You should not rely on any statement made through the platform in respect of a particular property without first confirming it with the lister.

5.1 Use of the platform does not of itself constitute the appointment of Cashout as your agent, and nothing on the platform creates a relationship of agency between us.

5.2 Cashout, or persons associated with it, may in some transactions act as an agent. Any such appointment is made separately and in writing, and is governed by the Estate Agents Act 2010 and its subsidiary legislation rather than by these Terms.

5.3 No payment is collected or held through the platform. We do not receive deposits, option fees or any other sums on behalf of any user.

5.4 Submitting a listing and searching listings are provided without charge. Should this change, notice will be given before any charge applies to you.

6.1 You retain ownership of the content you submit.

6.2 You grant Cashout a non-exclusive, royalty-free licence to store, reproduce and display that content on the platform, and to use it to respond to enquiries concerning the property to which it relates. That licence subsists for so long as the listing is published and thereafter only to the extent required for our records and for compliance with our legal obligations.

7.1 You must not use the platform to advertise anything other than property; harvest listings, contact particulars or other content by automated means; obtain or attempt to obtain access to accounts, listings or data that are not yours; interfere with the operation or security of the platform; or misrepresent your identity or your authority to act.

7.2 We may suspend or terminate access to the platform, and remove any content, where we consider on reasonable grounds that this clause has been breached.

8.1 The platform is provided on an "as is" and "as available" basis. We do not warrant that it will be available uninterrupted or free from error, that any response will be accurate, or that any listing will result in a transaction.

8.2 To the fullest extent permitted by law, Cashout excludes all warranties, conditions and terms implied by statute or common law, and shall not be liable for any indirect or consequential loss, or for loss of profit, opportunity, goodwill or anticipated savings, arising from or in connection with your use of the platform, the inaccuracy of any listing, or any dealing you enter into with a person introduced through the platform.

8.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or limited.

9.1 You agree to indemnify Cashout against any claim, loss, liability or expense (including reasonable legal costs) arising from content you have submitted, from your breach of these Terms, or from your breach of any applicable law.

10.1 We may amend these Terms from time to time. The date stated above indicates when they were last amended. Your continued use of the platform after that date constitutes acceptance of the Terms as amended.

11.1 These Terms are governed by and construed in accordance with the laws of Singapore.

11.2 The courts of Singapore shall have exclusive jurisdiction in respect of any dispute arising out of or in connection with these Terms.
